Welcome to Samarpan Resort & Banquet. These Terms and Conditions ("Terms") govern your use of our premises, services, website, and all bookings made through our platforms or representatives. By using our services, you agree to abide by these Terms. Kindly read them carefully.

  1. GENERAL DEFINITIONS
    We may collect the following types of information:
    • “We,” “Us,” “Our,” “Samarpan” refer to Samarpan Resort & Banquet, located at Gobarsahi – Sakari Road, Bakarpur, Muzaffarpur, Bihar 844127.
    • “Client,” “You,” “User,” “Guest” refer to anyone using our services or visiting our premises.
    • “Vendors” refer to service providers directly or indirectly engaged in delivering event-related services.
    • “Website” refers to www.samarpanresorts.com and all associated digital platforms.
    • “Event” includes weddings, receptions, corporate gatherings, private parties, and any other celebration organized on our premises.
  2. BOOKINGS & RESERVATIONS
    • A reservation is considered confirmed only after full/partial advance payment and acknowledgment from the management.
    • We reserve the right to deny booking or cancel events that may be unethical, unlawful, or violate public decency, local administration rules, or safety protocols.
    • The client is required to share accurate information during the booking process.
    • Government-issued ID proof is mandatory for bookings and stay.
    • All bookings are non-transferable without written approval.
  3. PAYMENTS, INVOICING & TAXES
    • All pricing is subject to applicable GST and service taxes under Indian law.
    • Accepted payment methods include UPI, Net Banking, Credit/Debit Cards, and Cheques (subject to clearance).
    • A detailed invoice will be issued post-confirmation, and all charges must be settled before or on the day of the event unless otherwise agreed.
    • Any delay in payments beyond agreed timelines will attract a penalty of 2% per day.
  4. CANCELLATION & REFUND POLICY
    • More than 30 days before event: 75% refund
    • 15–30 days before event: 50% refund
    • 7–14 days before event 7–14 days before event
    • Less than 7 days: No refund
    • Refunds will be issued to the original payment source within 7–14 working days.
    • In case of natural disasters, government mandates, or unavoidable circumstances, we may offer a refund or reschedule, based on the situation and terms of the Force Majeure clause.
  5. EVENT CONDUCT & GUEST RESPONSIBILITIES
    • Strict Prohibition of Alcohol:
      As per Bihar state laws, possession, consumption, or distribution of alcohol on Samarpan premises is strictly prohibited for all individuals, including guests, vendors, suppliers, visitors, and employees.
      Any violation may result in immediate cancellation of the event, expulsion from the premises, and reporting to legal authorities.
    • Safety and Compliance:
      Guests must comply with local laws, venue rules, safety, and fire regulations.
    • Food, Drinks, & restricted stuffs: Consumption of alcohol, spirits, toxic drinks, drugs, any restricted animal or living things, etc., is strictly prohibited for all individuals, including guests, vendors, suppliers, visitors, and employees. Also, for non-vegetarian food, it must be pre-approved and subject to regional permissions.
    • Loud music is allowed up to permissible limits and must cease as per local municipal norms.
    • Any damage to property, furniture, electronics, or landscape caused by guests or vendors will be charged to the client.
    • We reserve the right to remove or report unruly, abusive, or intoxicated individuals to maintain decorum.
  6. VENDOR & THIRD-PARTY SERVICES
    • Samarpan allows clients to bring external vendors (e.g., decorators, DJs, photographers), subject to approval and compliance with resort rules.
    • Vendors, suppliers, or any third-party collaborators must abide by alcohol prohibition laws. They ensure that no alcoholic substances are introduced, stored, or consumed on-site.
    • Sign an undertaking agreeing to comply with Samarpan’s zero-alcohol policy.
    • Failure to comply will lead to cancellation of vendor agreements, financial penalties, and possible legal reporting.
    • In case of Samarpan's recommended vendors, we ensure coordination but do not take legal or financial liability for their independent acts.
    • External vendors must register with the management at least 7 days before the event and comply with safety and security protocols.
    • The resort reserves the right to reject or blacklist non-compliant vendors.
  7. ACCOMMODATION & PROPERTY USE
    • Deluxe rooms and guest accommodations must be booked separately and follow standard hotel policies, including check-in/check-out timing, ID verification, and guest limits.
    • Use of the lawn, pavilion, banquet, or any part of the premises is restricted to booked hours only.
    • Any overuse beyond contracted hours may attract additional charges.
    • Alcohol-Free Policy in Rooms and Common Areas:
      Bringing or consuming alcohol in Samarpan premises is restricted. No one is permitted to bring or consume alcohol or anything against the law.
      Non-compliance will result in eviction without refund and legal escalation.
  8. WEBSITE, SOCIAL MEDIA & DIGITAL PLATFORMS
    • Use of our website or platforms for spamming, malicious activity, or data scraping is strictly prohibited.
    • Content published on our website or social pages (including images, video, testimonials) may be used for marketing purposes with appropriate consent.
    • You agree not to misuse or impersonate others, post hate speech, or misrepresent facts in reviews, comments, or posts.
  9. DATA COLLECTION & USAGE
    All data shared by users, customers, vendors, or visitors may be:
    • Stored securely in accordance with India's IT Act, 2000, and data protection guidelines.
    • Used for internal recordkeeping, booking history, loyalty programs, or promotional purposes.
    • Shared with trusted third parties (e.g., payment gateways, government bodies) where legally or functionally required.

  10. INTELLECTUAL PROPERTY
    • All logos, texts, images, videos, and digital designs belong to Samarpan Resort & Banquet and may not be reused without written consent.
    • Violations may result in legal action under Indian Copyright and Trademark Law.
  11. LIABILITY LIMITATION
    Samarpan is not responsible for:
    • Vendor mismanagement (unless directly contracted by us).
    • Loss or theft of personal items during events.
    • Guest injuries resulting from negligent behavior or intoxication.

    • Arrests, fines, or legal actions resulting from guest/vendor misconduct.
  12. FORCE MAJEURE
    Samarpan is not liable for performance failures due to:
    • Natural calamities (flood, earthquake)
    • Fire, pandemic outbreaks
    • Government regulations or bans
    • Civil unrest, strikes, terrorism, or lockdowns
    We will strive to offer rescheduling or partial refunds wherever feasible.
  13. Fireworks & Weapons
    Bringing, storing, or using fireworks, firearms, explosives, or any weaponry within Samarpan premises is strictly prohibited under the Arms Act and the Explosives Act applicable in Bihar. Violators may face immediate expulsion, event cancellation without refund, and legal action.
  14. Food & Catering Safety
    Only licensed food services are permitted. Outside food must comply with FSSAI guidelines. All food served must meet hygiene and safety standards. Spoiled or unhygienic food brought in by third parties is strictly discouraged and may lead to penalties.
  15. Event Safety Guidelines
    All events must comply with safety norms, including fire safety, electrical load restrictions, and crowd control. The client must inform the management in writing if any potentially risky activity is planned (e.g., fire rituals, water features, or live animals).
  16. Surveillance & Security
    Samarpan maintains CCTV surveillance in common and public-use areas to ensure guest safety. By entering the premises, guests consent to being recorded for security and operational purposes. Misuse or damage to security infrastructure will be penalized.
  17. Amendments
    These Terms may be updated from time to time. All changes will be reflected on our website and considered binding once published.
  18. Govering Law & Jurisdiction
    These Terms are governed under the laws of India, specifically the Bihar Prohibition and Excise Act, 2016, and any disputes shall be subject to the jurisdiction of the Muzaffarpur District Court.
